How Uncontested Divorce Services Can Prevent Unnecessary Court Action

When Clarity Prevented Unnecessary Court Filings

Helping a Parent Understand Their Options Before Reacting

The Client's Core Question:
“Do I have to go to court over this right now?”

A parent feared imminent litigation after receiving a stressful attorney email. There had been an error and a mistake made but it could be corrected. Nevertheless, the co-parent's attorney was threatening our client with emergency orders of protection and restraining orders and the client did not know how those threats matched the family goal to avoid court, work out issues privately, and move forward.

Practitioner Approach:
I reviewed the situation calmly and assessed what required immediate action and what did not. Within a short period of time, I identified a practical path forward that addressed the core concerns, corrected a mistakenly depleted account, and proposed trust-building steps designed to de-escalate the situation.

These recommendations were explained both verbally and in writing so the client could absorb the information during a period of heightened stress and revisit it later. With a clear plan in place, the client was able to act thoughtfully rather than reactively.

“With clarity and a steady plan, this parent avoided unnecessary litigation and regained their sense of control.” ~ Erin Birt, Uncontested Divorce Attorney

Value Provided:
With a clear, written plan and time to process the recommendations, the client was able to respond calmly and proactively rather than escalate out of fear. This approach helped stabilize the situation, reduce uncertainty, and keep the matter on a path toward resolution without unnecessary court involvement.
